1.0 Introduction

K-12 Studio (k12studio.ca) is a free, government-supported platform for Ontario K–12 French as a Second Language (FSL) educators to find, share, and create classroom resources. K-12 Studio is funded by the Ontario Ministry of Education and Heritage Canada.

These Terms of Use govern your access to and use of k12studio.ca and all services offered through the platform. Please read them carefully.

2.0 Acceptance of Terms

By accessing or using k12studio.ca, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the platform.

If you are accessing the platform on behalf of a school board or other organization, you represent that you have authority to bind that organization to these Terms.

3.0 Description of Service

K-12 Studio provides Ontario FSL educators with:

  • A searchable library of FSL resources tagged by grade level, program type, and Ontario Curriculum expectations
  • Tools to upload and share your own FSL resources
  • A free H5P-based authoring tool to create interactive classroom activities
  • A public contributor profile linked to resources you share

The platform is intended for K–12 educators. Use of K-12 Studio is free of charge and does not require a paid subscription.

4.0 User Obligations

4.1 Registration

You must provide accurate and complete information when creating an account, including your first and last name and a valid email address. You are responsible for keeping your account information current. Providing false information, including impersonating another person or educator, is grounds for account termination.

4.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at info@k12studio.ca if you suspect unauthorized use of your account.

4.3 Compliance with Canadian Law

You must comply with all applicable Canadian federal and provincial laws in your use of the platform, including the Copyright Act (R.S.C., 1985, c. C-42) as amended by the Copyright Modernization Act (S.C. 2012, c. 20), Canada's Anti-Spam Legislation (CASL), the Personal Information Protection and Electronic Documents Act (PIPEDA), and the Accessibility for Ontarians with Disabilities Act (AODA).

5.0 Acceptable Use

5.1 Permitted Use

K-12 Studio is for personal, non-commercial, and educational use by Ontario FSL educators. You may use the platform to find, share, create, and download FSL resources for classroom use.

5.2 Prohibited Activities

You may not:

  • Use the platform for any commercial purpose, including selling resources or advertising services
  • Upload content to which you do not hold the rights, or which infringes the copyright, trademark, or other intellectual property rights of any third party
  • Upload content that is inappropriate for an educational context, including content that is offensive, discriminatory, obscene, or harassing
  • Use the platform in any way that could harm minors
  • Collect, harvest, or scrape personal information about other users without authorization
  • Send unsolicited bulk messages through the platform or to other users
  • Attempt to gain unauthorized access to any part of the platform, its servers, or other users' accounts
  • Use automated tools (bots, scrapers, crawlers) to access the platform without written permission
  • Misrepresent your identity, credentials, or affiliation with any school, board, or organization

6.0 Content and Intellectual Property

6.1 Your Ownership

You retain ownership of the content you create and upload to K-12 Studio. We do not claim ownership of your resources.

6.2 License You Grant to K-12 Studio

By uploading content to K-12 Studio, you grant K-12 Studio a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute your content solely for the purpose of operating the platform and making your resources available to other users. This license does not permit K-12 Studio to sell your content or use it for purposes unrelated to operating the platform.

6.3 License Requirement for Uploaded Resources

You must select a Creative Commons license for each resource you upload before submission is permitted. K-12 Studio does not apply a default license. Resources submitted without a license selection will not be accepted by the system.

By selecting a Creative Commons license, you represent that you have the right to apply that license to the content, and you understand that the license grant to other users is irrevocable once the resource is published. Available license options are:

  • CC BY 4.0 — Attribution
  • CC BY-SA 4.0 — Attribution-ShareAlike
  • CC BY-NC 4.0 — Attribution-NonCommercial
  • CC BY-NC-SA 4.0 — Attribution-NonCommercial-ShareAlike
  • CC BY-ND 4.0 — Attribution-NoDerivatives
  • CC BY-NC-ND 4.0 — Attribution-NonCommercial-NoDerivatives

Descriptions of each license are available at creativecommons.org/licenses.

6.4 Existing Third-Party Content

Some resources on K-12 Studio may be covered by existing open licenses, including Creative Commons, Public Domain, or equivalent. Each such resource will display its applicable license. Users are responsible for reviewing and complying with those license terms when downloading or reusing content.

6.5 What Happens When You Delete Your Account

If you delete your account, resources you have uploaded will remain on the platform under the Creative Commons license you selected at the time of upload. Your name as contributor may remain associated with those resources. If you wish to request removal of specific resources before deleting your account, contact us at info@k12studio.ca and we will review the request.

6.6 K-12 Studio's Intellectual Property

The K-12 Studio name, logo, branding, platform design, and all non-contributed content are the property of K-12 Studio or its licensors. You may not use them without express written permission.

6.7 Copyright Infringement Reports

If you believe content on K-12 Studio infringes your copyright under the Canadian Copyright Act, please contact us at info@k12studio.ca with the following information: a description of the work you believe is infringed; the URL of the allegedly infringing content; your contact information; and a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law. We will investigate and respond promptly.

7.0 Privacy

Your use of K-12 Studio is also governed by our Privacy Policy, available at k12studio.ca/privacy. The Privacy Policy explains what personal information we collect, how we use it, and your rights. By using the platform, you agree to the collection and use of your information as described in the Privacy Policy.

8.0 Accessibility

K-12 Studio is committed to making the platform accessible to all users in accordance with the Accessibility for Ontarians with Disabilities Act (AODA) and the Web Content Accessibility Guidelines (WCAG) 2.1. If you encounter an accessibility barrier or require accommodation, please contact us at info@k12studio.ca and we will work with you to address it.

9.0 Indemnification

You agree to indemnify and hold harmless K-12 Studio, its team members, contractors, and funders from any claim, loss, or expense — including reasonable legal fees — arising directly from your violation of these Terms or your unauthorized use of third-party content you uploaded to the platform.

This indemnification applies to your own conduct and content. It does not hold you responsible for actions taken by K-12 Studio or other users of the platform.

10.0 Termination

K-12 Studio may suspend or terminate your account if you violate these Terms, upload infringing or inappropriate content, or engage in conduct that harms other users or the platform.

Where possible, we will notify you of the reason for termination and provide a reasonable opportunity to retrieve records of your contributions before access is removed. We reserve the right to terminate access immediately and without notice where the violation is serious, including but not limited to content that harms minors or constitutes copyright infringement.

You may close your account at any time by contacting info@k12studio.ca.

11.0 Disclaimer and Limitation of Liability

K-12 Studio is provided "as is" and "as available." We do not guarantee that the platform will be uninterrupted, error-free, or free of harmful components. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for purpose of any content on the platform, including resources uploaded by other users.

To the maximum extent permitted by applicable law, K-12 Studio and its team, funders, and contractors shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use the platform, including loss of data or reliance on content found on the platform.

Nothing in this section limits your rights under applicable Canadian consumer protection law.

12.0 Modifications to These Terms

We may update these Terms at any time. When we do, we will post the revised Terms at k12studio.ca/terms and update the "Last Updated" date at the top of this document. For significant changes, we will also post a notice on the platform homepage.

Updated Terms are effective immediately upon posting. Continued use of the platform after updated Terms are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the platform and may contact us to close your account.

13.0 Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

If you access K-12 Studio from outside Ontario, you remain subject to these Terms and responsible for compliance with your local laws.
